John Creuzot, district attorney-elect in Dallas County, says a murder charge would be appropriate in the fatal shooting of Botham Jean in his apartment by Dallas police officer Amber Guyger.

Guyger has said she mistook Jean’s apartment for her own, thought he was an intruder and shot him. Jean is a Harding University graduate.

John Creuzot told WFAA-TV (Channel 8) that murder would be the “most appropriate charge” based on his knowledge from news coverage of the Sept. 6 shooting. He said the district attorney is not bound to follow the charge police bring on a case and can downgrade or upgrade charges.

Creuzot, a former judge and prosecutor who beat District Attorney Faith Johnson in the Nov. 6 election, said in September that the manslaughter charge was a “deviation from the norm.” Dallas County authorities have charged suspects in similar cases with murder, he said.
