Gov. Asa Hutchinson has appointed Little Rock District Judge Hugh Finkelstein to sit as a special justice on the Arkansas Supreme Court to hear lawsuits seeking to have the casino expansion amendment removed from the ballot.

Arkansas Supreme Court Chief Justice Dan Kemp also yesterday said he would not participate in a case seeking to toss the casino expansion amendment off the ballot. He did not give a reason.

Arkansas Supreme Court Justice Dan Kemp today filed a one-sentence letter announcing his recusal from the lawsuit seeking to remove Issue One from the ballot. By Kemp's standard, Justice Shawn Womack should follow.

A lawsuit was filed today in Circuit Court saying Issue One, proposed by the legislature, should be removed from the ballot because it unconstitutionally proposes four separate constitutional amendments to voters in one ballot measure and fundamentally rewrites the balance of power in the Arkansas Constitution without informing voters of the fact.

The Arkansas Supreme Court on Thursday reversed and dismissed a minimum-wage lawsuit against the state based on a sovereign immunity defense raised by the attorney general's office — even though the state had explicitly stated that it would not assert sovereign immunity when the suit first began.

Another division emerged on an administrative matter today in opinions of the Arkansas Supreme Court. It concerns how cases are parceled out among the 17 judges who sit in circuit court in Little Rock.

Former Gov. Mike Beebe and Sen. Jonathan Dismang hosted a fund-raiser for Courtney Goodson's campaign for chief justice last night. Legal or not, it's another illustration of the ill appearance of judicial candidates soliciting money from people who'll have interest in cases in their court.

Supreme Court candidate Courtney Goodson has a penchant for using social media to post photos of herself with prominent elected politicians. A complaint to ethics regulators probably will go nowhere, but it doesn't mean it's a good idea.
